Your AFL Moment Terms And Conditions

    1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
    2.Entry and voting is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, the Australian Football League (AFL) and agencies associated with this promotion are ineligible.
    3.Promotion commences at 9am AEST on 22/03/2010 and closes at 11:59pm AEST on 19/09/2010 (“Promotional Period”). There will be 22 rounds conducted for this promotion during the Promotional Period (“Rounds”). Entries for each Round will close at 11:59pm AEST on the dates indicated in the table below. Voting will close for each Round at 11:59pm AEST on the dates indicated in the table below. All times mentioned through these Terms and Conditions are based on Australian Eastern Standard Time or Australian Eastern Day Light Saving Time, as and when applicable in NSW.

    4.Entries for the Toyota AFL Grand Final Round will commence at 12:00am AEST on Monday 23/08/2010. Voting will close at 11:59pm AEST on 19/09/2010.

    5.In the promotion, eligible individuals can enter their own AFL Moment into a Round of the promotion, in accordance with these Terms and Conditions, for the chance to win the prize that is connected with that Round. Eligible individuals will then be able to vote on their favourite AFL Moment to determine the winner of each Round.

    6.To be eligible to enter or vote, the entrant must become a fan of the Promoter’s Facebook page, during the Promotional Period, if they have not done so already. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. You understand that you are providing your information to the Promoter and not Facebook. The information you provide will only be used for the purposes as set out in these Terms and Conditions. Any questions, comments or complaints should be directed to the Promoter and not Facebook.
    7.To enter, the eligible entrant must create their own AFL Moment. Entrants acknowledge and agree that the AFL Moment must not contain any images of any ex-AFL player or current AFL player, and it must be their own recreation using their own personally produced material. The AFL Moment can either be produced in the form of a photograph or a video. The video or photograph must comply with any format and size requirements as specified by the Promoter.
    8.To enter the promotion, the eligible entrant must visit YOUR AFL MOMENT at http://apps.facebook.com/youraflmoment follow the prompts and enter in accordance with the directions. As part of the entry process, the eligible entrant will be required to enter the Round in which they wish to be entered. In order to be entered in the particular the Round, they must enter during the relevant entry period for that Round as detailed above. Incomplete, indecipherable or inaudible entries may be deemed invalid by the Promoter, in its absolute discretion.
    9. Entrants agree to the following conditions:

(a) when you submit any materials for the promotion, including videos and photos (“Content”), you, unless the Promoter advises otherwise, license and grant the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. You agree not to assert any moral rights in relation to such use. You warrant that you have the full authority to grant these rights.

(b) You agree that you are fully responsible for the Content you submit. You acknowledge that the Promoter, in its absolute discretion, may remove any Content from display at any time for any reason whatsoever, including but not limited to, where the Promoter reasonably suspects the Content does not comply with these Terms and Conditions. Notwithstanding the Promoter’s right to remove any Content at any stage, the terms and warranties as set out in these Terms and Conditions will still apply. The Promoter shall not be liable in any way for such Content to the full extent permitted by law.

(c) You warrant and agree that:

i) you will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;

ii) you will only submit Content which you have personally created;

iii) your Content will not contain the image of any current or ex-AFL player;

iv) your Content will not contain any footage of AFL events or matches;

v) your Content shall not contain viruses or cause injury or harm to any person or entity;

vi) if your Content depicts any person other than you, you have obtained their consent to submit your Content for the purposes of the promotion; and

vii) you will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

Without limiting any other terms herein, you indemnify the Promoter and the AFL, for any breach of the above terms of Clause 9.

    10. Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.
    11. To submit a vote in the promotion, the eligible vote must visit YOUR AFL MOMENT at http://apps.facebook.com/youraflmoment, follow the prompts and vote in accordance with the directions.
    12. Multiple votes are permitted, subject to the following: only one (1) vote permitted per person per video/photo. Incomplete, indecipherable, or illegible votes may, in the absolute discretion of the Promoter, be deemed invalid.
    13. Entrants and voters warrant that they will only use one (1) personal email address in connection with their participation in the promotion.
    14. The Promoter reserves the right, at any time, to verify the validity of entries, votes and entrants and voters (including an entrant’s or voter’s identity, age and place of residence) and to disqualify any entrant or voter who submits an entry or vote that is not in accordance with these Terms and Conditions or who tampers with the entry or voting process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    15. This is a game of skill and chance plays no part in determining the winners. The winner of each Round will be the entrant who submitted the entry with the highest number of recorded votes during the voting period. If two or more entrants receive the same amount of votes and are tied for top place, the judges in their absolute discretion will determine the winning entries from those tied entries based on creative merit. The Promoter’s decision is final and no correspondence will be entered into.
    16. The winning entry in each Round will win the relevant number of tickets to the relevant AFL match as specified in the table below. The winner for each Round will be notified by email. The original winners will be required to contact the Promoter via email or phone to provide their contact details, from which they will be contacted to claim their prize and confirm that they will attend by 3pm on the Tuesday after the Voting Closing Date. If an original winner does not claim their prize by the required time, then it will be forfeited and will be offered to a reserve. The reserve will then be contacted by private email message. The reserve will be required to contact the Promoter via email or phone to provide their contact details, from which they will be contacted to claim their prize and confirm that they will attend by 5pm on the Wednesday after the Voting Closing Date. If this person does not respond in the required timeframe, then the prize will be forfeited. It is the entrant’s responsibility to check their email to see if they have received a winner notification message.

“ES” means (Etihad Stadium); “G” means (Gabba); “S” means (Subiaco); “AU” means (Aurora Stadium); “AS” means (AAMI Stadium); “MCG” means (Melbourne Cricket Ground); and “SCG” means (Sydney Cricket Ground). Locations and times are subject to variations.

    17. Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. In the event that any prize is unavailable, due to reasons beyond the control of the Promoter, the Promoter will offer an alternative prize of equivalent standard and specification. Prizes must be taken to coincide with the relevant match. The prizes include the tickets only. The winner and his or her companions are responsible for all other costs involved with attending the match.
    18. The Promotional code for the 2010 Toyota AFL Grand Final tickets is GFAFL10/17. Tickets to the relevant events may not without the written consent of the Promoter, AFL and Ticketek, be re-sold or used for advertising, promotion or commercial purposes or to enhance the demand for other goods or services. If a ticket is sold or used in breach of condition, the bearer of the ticket will be refused admission.
    19. Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
    20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including as a result of mechanical tampering or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant or voter, including any votes or entries submitted by them; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
    21. Any cost associated with accessing the promotional website is the entrant’s or voter’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly or a voter to automatically vote repeatedly, is prohibited and may render all entries or votes submitted by that entrant or voter invalid.
    22. Except for any liability that cannot be excluded by law, the Promoter and the AFL (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; (f) a prize; or (g) making and filming the video or photograph for the purpose of the promotion.
    23. It is a condition of accepting a prize that the winner signs a legal release in the form determined by the Promoter.
    24. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
    25. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the Entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
