COMPETITION TERMS AND CONDITIONS

1. INTRODUCTION

1.1 The following terms and conditions apply for Viera Bonus Wii Online Competition (the “Competition”) and by submitting an entry into this Competition, entrants warrant that they have read, understand and agree to be bound by them.

1.2 These terms and conditions can be collected from the Panasonic consumer blog website http://blogs.panasonic.com.au/consumer/ (”the website”).

2. THE PROMOTER

2.1 The promoter is Panasonic Australia Pty Limited (ABN 83 001 592 187) of Austlink Corporate Park, 1 Garigal Road, Belrose NSW 2085 (the “Promoter”).

3. COMPETITION DURATION

3.1 The Competition will be conducted between 9:00am and 11.59pm on every weekday (i.e. Monday to Friday) during the period of Monday 29 June 2009 to Friday 31 July 2009, excluding public holidays (the “Competition Period”).

3.2 There will be a daily challenge (the “Daily Challenge”) conducted between 9:00am and 11.59pm on each day of the Competition Period. Each of one these days will be deemed a “Competition Day”.

3.3 All times referred to throughout these terms and conditions are based on Australian Eastern Standard Time.

4. ONLINE SOCIAL NETWORK CHANNELS

4.1 The Competition will be run on selected online social network channels (the “Social Networks”). In order to participate in a Daily Challenge, entrants may be required to join one or more of the Social Networks, if they have not done so already. By joining the Social Networks, entrants acknowledge and agree to the terms of use and other policies that apply to the use of those Social Networks.

4.2 Within the Social Networks, the Promoter will have its own dedicated channel or profile by which the Daily Challenges will be conducted through or via ( the “Panasonic Social Network Channels”), as detailed below:

(a) Panasonic Australia Twitter profile;

(b) Panasonic Australia Facebook profile;

(c) Panasonic Consumer Blog;

(d) Panasonic YouTube channel;

(e) Panasonic Flickr profile;

(f) Panasonic Audioboo profile; and

(g) Panasonic 12seconds profile.

5. ELIGIBILITY

5.1 Subject to condition 5.1 and 5.3, entry is available to permanent residents of Australia. Individuals under 18 years of age must obtain their parent’s or guardian’s consent to enter.

5.2 Employees and the immediate families of the Promoter and its related bodies corporate are ineligible to enter. Employees and the immediate families of all associated sponsors, agencies and participating companies are also ineligible to enter.

5.3 Entrants warrant that they are entering this Competition in a wholly private nature and are not entering on behalf of a business or enterprise activity they are involved in.

6. METHOD OF ENTRY AND ENTRY INFORMATION

6.1 Online users will be invited to enter particular Daily Challenges through one or more of the Panasonic Social Network Channels. Information on particular Daily Challenges will be released through selected Social Network Channels or Panasonic Social Network Channels at selected times throughout the Competition Period.

6.2 Information on how to enter and prizes will form part of these terms and conditions. Information on how to enter the particular Daily Challenge, including but not limited to, the following, will be released on the relevant Competition Day in the morning before the commencement of that Daily Challenge:

(a) Information on how to enter, including details of the relevant Panasonic Social Network Channel(s) that must be used for the purpose of submitting the entry;

(b) The criteria by which the entries will be judged; and

(c) Details on where the winner will be announced.

6.3 Entrants must complete the relevant Daily Challenge between 9am and 11.59pm on the specified Competition Day, in accordance with the information on how to enter and these terms and conditions, to qualify for entry into that particular Daily Challenge.

6.4 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence and request identification confirming the same) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter reserves the right to request that the entrant return the prize (or a sum equivalent to the prize), if the Promoter, in its reasonable opinion, believes that the entrant has infringed these terms and conditions or tampered with the entry process, despite the fact that the Promoter has advertised the individual as a prize winner and awarded them the prize.

6.5 Incomplete, indecipherable, or illegible entries will be deemed invalid.

6.6 Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

6.7 Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

6.8 An entrant is allowed to enter as many times as they like during the course of the Competition but can only win once. Once an entrant has been awarded a Wii Console, any subsequent entries will not be eligible for any prizes.

6.9 Entrants’ entries are required to comply with any format, size, word length or content requirements as specified in information released by the Promoter or in accordance with the Social Networks.

6.10 Entrants acknowledge and agree that entries may be removed from any of the Panasonic Social Network Channels by: (a) the Promoter for any reason whatsoever, including but not limited to, where the entrant has breached these terms and conditions; or (b) the providers of those Social Networks at anytime; and the Promoter will not be held responsible if entries are removed.

7. JUDGING

7.1 Each Daily Challenge is a game of skill and chance plays not part in the determination of any winner(s) in the Competition. All entries will be judged according the criteria specified by the Promoter in the information on how to enter. The Promoter’s decision in relation to all matters pertaining to this Competition is final and no correspondence will be entered into.

7.2 Entrants acknowledge and agree that they will only rely on official information about the Competition, that is released by the Promoter, and should not rely on the information or opinion of any entrant or any other person posted via or on any of the Social Networks or in any other media.

7.3 The Promoter will select winner(s) for each Competition Day as stated below for the period 29 Monday 2009 to 31 July 2009. The number of the winners for each Daily Challenge and the criteria by which these winner(s) will be selected will be in accordance with the information that is stated below:

7.4 The best entry or entries (as the case requires and as determined by the judges), in each Daily Challenge, will each win the prize.

8. PRIZES

8.1 All prize values are the recommended retail value as provided by the supplier, are in Australian dollars and are correct at the time of printing. The Promoter accepts no responsibility for any variation in the value of the prize.

8.2 Each prize is one (1) Nintendo Wii Game Console valued at $399.95. There will be a maximum of 37 prizes awarded in the Competition.

8.3 If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.

8.4 Prizes are not transferable, exchangeable and cannot be taken as cash.

8.5 If a prize winner has received a Wii through this Competition and requires customer support, troubleshooting assistance or has an enquiry relating to the warranty of the Wii, winners should contact Nintendo Australia. Details can be found at www.nintendo.com.au. In all other instances, enquiries about this Competition are to be directed only to the Promoter on 132 600.

9. NOTIFICATION

9.1 All prize winner(s) in the previous week will be posted on the Panasonic Blog at http://blogs.panasonic.com.au/consumer/ on the Monday following that week.

9.2 Daily Challenge winner(s) will also be announced through the Panasonic Twitter channel.

9.3 It is the winner’s full responsibility to respond with contact details necessary for prize fulfilment. A contact email will be supplied on the website for the supply of contact information.

9.4 Should acceptance of the prize and supply of details not occur within two (2) weeks of winning, then the relevant prize winner will be deemed to have forfeited their prize.

9.5 Instructions on how to claim the prize form part of these terms and conditions.

9.6 If there is a dispute as to the identity of a prize winner, the Promoter in its absolute discretion will determine the winner.

10. PRIZE DELIVERY

10.1 Prizes will be mailed to the winner(s) based on the information supplied by the winner to the Promoter. The Promoter accepts no responsibility for the non-receipt of prize due to incorrect or incomplete details.

10.2 The Promoter reserves the right to request winners to provide proof of identity, proof of residency and/or proof of entry validity in order to claim a prize. Proof of identity, residency and/or entry validity considered suitable for verification is at the Promoter’s discretion. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

11. CONTENT SUBMISSION

11.1 When you submit any materials via the Competition including comments, recordings and images (”Content”), you, unless the Promoter advises otherwise, license and grant the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. You agree not to assert any moral rights in relation to such use. You warrant that you have the full authority to grant these rights.

11.2 You agree that you are fully responsible for the Content you submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law.

11.3 The Promoter may remove any Content without notice for any reason whatsoever, including but not limited to, where the Promoter may deem the Content to be unlawful or fraudulent, in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;

11.4 You warrant and agree that:

(a) you will not submit any Content that is unlawful or fraudulent, or that is in breach of any intellectual property, privacy, publicity or other rights, or that is defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;

(b) you will obtain prior consent from any person or property that appears in your Content;

(c) you will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein;

(d) your Content shall not contain viruses or cause injury or harm to any person or entity; and

(e) you will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

11.4 Without limiting any other terms herein, you indemnify the Promoter for any claims, losses, or damages, of any kind whatsoever, as a result of any breach of the above warranties.

12. PUBLICITY MATERIALS

12.1 Without limiting the operation of any other terms herein, including the rights to use Content in accordance with condition 11.1, entrants acknowledge that it is a condition of entry, that upon reasonable request by the Promoter, they consent to the Promoter using their name, image and/or voice to be used in connection with publicity materials (the “Publicity Materials”), and will participate in any interview, photo, recording, video and/or film session(s) for the purpose of creating such Publicity Materials, and that the Publicity Materials can be used for the purpose of promoting this Competition, or its outcome, or any of the Promoter’s products of services, and that the Promoter has the right to use the Publicity Materials in any medium (including, without limitation, on the internet) and in any reasonable manner it sees fit for no further compensation. Any copyright in the Publicity Materials will vest in the Promoter. Individual agrees not to assert any moral rights in relation to such use of the Publicity Materials.

13. LIABILITY

13.1 Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, agents and contractors) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or due to technical difficulties or equipment malfunction; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; (f) use of the prize; or (g) if any Social Networks are cancelled, terminated or suspended.

13.2 The use of any automated entry software or any other mechanical or electronic means that permits any person to enter the Competition repeatedly is prohibited.

13.3 If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

13.4 The Promoter reserves the right to revise these terms and conditions at any time by placing a revised version of the terms and conditions on the website. Entrants should therefore regularly check these terms and conditions.

14. PRIVACY

14.1 The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. The Promoter’s privacy policy can be accessed at www.panasonic.com.au.

14.2 Entrants acknowledge that social networking sites are open to the world at large, and accordingly any personal information posted may be accessed by the world at large.
